These Terms of Service ("Terms") govern your access to and use of Globeneer's websites, forms, text messaging programs, and travel referral services (collectively, the "Services"). By using the Services, submitting a travel inquiry, or consenting to receive our text messages, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who We Are
Globeneer is an independent travel referral and concierge service that helps travelers discover and book travel experiences through its network of travel suppliers (airlines, hotels, cruise lines, tour operators, and destination management companies). Globeneer is not itself an airline, hotel, cruise line, tour operator, or insurer. We act as an intermediary between you and the travel suppliers whose products and services you ultimately purchase.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
3. Travel Inquiries and Bookings
When you submit a travel inquiry, we will use the information you provide to prepare travel options for you. Any booking you ultimately make is a contract directly between you and the relevant travel supplier. The supplier's own terms, conditions, cancellation policies, change fees, and baggage rules apply to that booking. You are responsible for reviewing those terms before you book.
Prices, availability, and itineraries are subject to change at any time until a booking is confirmed and paid for. We do our best to present accurate information but do not guarantee that any quoted price, route, or itinerary will remain available.
4. Text Messaging Programs
Globeneer operates two separate text messaging programs, each requiring its own express written consent that you provide by checking the corresponding box on our form:
- Transactional SMS: Messages from Globeneer regarding your travel inquiry, trip planning, booking confirmations, and itinerary updates.
- Promotional SMS: Messages from Globeneer about travel deals, vacation packages, and special offers.
Consent to receive text messages is not a condition of any purchase. Message frequency varies. Message & data rates may apply. Reply HELP for assistance. Reply STOP to any message to opt out of that program. Opting out of one program does not automatically opt you out of the other. Supported carriers include all major U.S. carriers. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or SMS consent records with third parties for their own marketing purposes.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms.
- Submit false, misleading, or fraudulent information, including phone numbers you do not control.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or our systems.
- Interfere with, disrupt, or create an undue burden on the Services or our networks.
- Use automated systems (bots, scrapers) to access or collect information from the Services.
- Reproduce, copy, or resell any portion of the Services or its content without our prior written consent.
6. Intellectual Property
All content on the Services, including the Globeneer name, logos, text, graphics, images, and software, is owned by or licensed to Globeneer and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only.
7. Third-Party Services and Links
The Services may contain links to third-party websites or services we do not control. We are not responsible for the content, privacy practices, or conduct of any third party. Your interactions with any third party are solely between you and that party.
8. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Globeneer disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Globeneer is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any travel supplier or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
9. Limitation of Liability
To the fullest extent permitted by law, in no event shall Globeneer, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Services, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Globeneer and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, your violation of any law or the rights of a third party, or any information you submit to us.
11. Dispute Resolution; Arbitration; Class Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that you may bring an individual claim in small-claims court if it qualifies.
Class Action Waiver. You and Globeneer agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Opt-out. You may opt out of this arbitration agreement by sending written notice to the mailing address listed in Section 16 within 30 days of first accepting these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Subject to Section 11, any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 6, 8–12) will survive.
15. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Globeneer regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent.
